Terms & Conditions

These Terms & Conditions apply to all photography services provided by Ralph Haville Photography ("the Photographer") to the client ("the Client"). By confirming a booking, the Client agrees to these Terms & Conditions.

1. Bookings

A booking is confirmed once the Client has accepted a quotation or confirmed the booking in writing via email or another agreed method. The Photographer will make every reasonable effort to provide the agreed services on the booked date and time.

2. Photography Services

The Photographer will provide photography services as agreed prior to the booking, including any agreed location, duration, style of photography and deliverables. Whilst every effort will be made to capture all key moments, photography is a live service and specific images or moments cannot be guaranteed.

3. Payment

Invoices are payable within 14 calendar days of the invoice date unless otherwise agreed in writing.

Payment can be made via bank transfer or any other payment method specified on the invoice. Late payments may result in delivery of photographs being delayed until payment has been received in full. The Photographer reserves the right to charge statutory interest and compensation on overdue invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

4. Expenses

Any agreed travel expenses, parking charges, accommodation costs or venue entry fees not included within the quotation may be added to the final invoice. These costs will always be discussed with the Client in advance where reasonably possible.

5. Cancellations & Rescheduling

If the Client needs to cancel or reschedule a booking, as much notice as possible should be provided. Any non-refundable expenses already incurred by the Photographer may still be payable. If the Photographer is unable to attend due to illness, emergency or circumstances beyond reasonable control, every reasonable effort will be made to arrange a suitable replacement photographer. If this is not possible, any payments already made for the photography services will be refunded in full. This shall be the Photographer's maximum liability.

6. Delivery of Images

Edited digital images will be delivered within the estimated timeframe discussed with the Client. Delivery times may vary depending on the size of the project and workload. Images are supplied in high-resolution digital format unless otherwise agreed.

7. Copyright & Image Usage

The Photographer retains the copyright and all intellectual property rights in all photographs produced, in accordance with UK copyright law. Upon full payment, the Client receives a non-exclusive licence to use the delivered photographs for their intended personal or business purposes.

The Client may not sell, licence, alter in a way that misrepresents the Photographer's work, or claim authorship of the photographs without prior written permission.

Unless otherwise agreed in writing before the booking, the Photographer reserves the right to use any photographs taken during the assignment for promotional purposes, including but not limited to:

  • Portfolio

  • Website

  • Social media

  • Marketing materials

  • Print and online advertising

  • Photography competitions or awards

If the Client requires complete confidentiality or does not wish images to be used publicly, this must be agreed in writing before the photography session.

The Photographer asserts both his moral right to be identified as the author of her work and the right to a credit (where possible) is asserted in accordance with Sections 77 – 79 of the Copyright, Designs and Patents Act 1988 or any amendment or re-enactment thereof. 8. Client Responsibilities

The Client is responsible for obtaining any permissions required for photography at the venue unless otherwise agreed. Where individuals require consent before being photographed, it is the Client's responsibility to ensure appropriate permissions have been obtained unless the Photographer has specifically agreed to manage this. The Client should ensure the Photographer has reasonable access to all agreed locations throughout the booking.

9. Image Editing

The Photographer will edit images in their own artistic style. Requests for extensive retouching or additional editing beyond the agreed package may incur additional charges.

10. Limitation of Liability

Whilst every reasonable care will be taken in producing and delivering photographs, the Photographer's liability is limited to the total value paid by the Client for the booking.

The Photographer shall not be liable for:

  • Circumstances beyond reasonable control

  • Illness/injury of The Photographer that prevents agreed duties being carried out

  • Venue restrictions

  • Poor weather

  • Delays caused by third parties

  • Missed photographs due to interference from guests or venue staff

  • Equipment failure where reasonable backup equipment has been carried

In the unlikely event of total photographic failure caused solely by the Photographer, liability will be limited to a refund of monies paid.

11. Image Storage

Final edited photographs will normally be retained for up to 3 months after delivery. Whilst reasonable efforts are made to archive images, permanent storage cannot be guaranteed. Clients are strongly advised to download and back up their photographs upon receipt.

12. Privacy

Client information is used solely for the administration of bookings and will be handled in accordance with applicable UK data protection legislation. Personal information will never be sold to third parties.

13. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
